GENERAL

Thank you for subscribing in My PRIME REWARDS. Please read these terms and conditions carefully relevant to the My PRIME REWARDS program.

The program is owned and operated by PRIME HEALTH CARE, whose principal office is at PRIME HEALTH Group Headquarters Building, No. 203, Shk. Saud Building, Opposite Al Reef Mall.Email Address: myprime@primehealth.ae | 047070999. Dubai - United Arab Emirates.

1.1 OVERVIEW

My PRIME REWARDS PROGRAM of PRIME HEALTHCARE GROUP is accessible through Mobile application >‘Prime health Me app’.

The Program allows patients to earn points when making any purchases or availing any services identified by the PRIME from time to time and to redeem these points against payment towards purchase of any products or services

Members acquire no vested right or entitlement to the continued availability of any particular reward, benefit, or redemption level.

We expect you to provide Business Standard with an accurate and complete information of the compulsory fields. We also expect you to keep the information secure, specifically access passwords and payment information. Kindly update the information periodically to keep your account relevant. Business Standard will rely on any information you provide to us.

1.2 ACCEPTANCE

By using or enrolling in the Program, you accept and agree to be bound by these Terms and Conditions.

Points will not be awarded if in the Company’s reasonable opinion, the merchandise purchased will be used for resale or commercial use and any points awarded on such purchases will be forfeited. If a Member was awarded points for an offer or promotion in which a Member purchased product(s) more than reasonable quantities, the points awarded as a result of that offer or promotion may be forfeited without prior notice.

If a Member does not meet the requirements set out above, all points awarded to such Member may be forfeited without prior notice.

PROGRAM MEMBERSHIP
2.1 MEMBERSHIP ENROLLMENT

Membership is free and no initial purchase is required in order to become a Member. To become a valid Member, you must complete the enrolment process by providing complete and accurate information and indicating your acceptance of the Program Terms.

Each Member is responsible to ensure that all Personal Information is correct and accurate. PRIME reserves the right to block redemptions where the Member information is inaccurate or incomplete. Members are solely and entirely responsible for keeping their Account secure.

Only one My Prime Rewards account (“Account”) is permitted per person.

Members who choose to enroll their children’s below 18 years of age would accept the terms and condition listed out in this document and shall remain responsible to abide by the terms as set out here. Terms and condition would be the same for all the members enrolling into this program.

2.2 PASSWORDS AND SECURITY

In order to enroll in the Program, you will have to enrol and confirm your Account with us and provide one or more names, email addresses, login usernames and passwords (together, “ID”). You are responsible for maintaining the confidentiality of your ID. You agree not to use the ID of any third party or disclose your ID to any third party. You are responsible for any and all activity that occurs on your Account. If you suspect any unauthorized use of your Account, you must notify us immediately. You agree to provide us with correct and complete Account information at all times and inform us of any changes to the information you have provided. We will keep your account information confidential

2.3 REVOKE / REVESAL

If the PRIME determines that a Program Member has abused any of the Program’s privileges, fails to comply with any of the Program Terms, or makes any misrepresentation to the PRIME, the PRIME may, in its sole discretion, take such actions as it deems appropriate, including without limitation, revoking or reversalof Member’s privileges under the Program, revoking any or all of the points in such Program

Member’s Account, and/or revoking the Program Member’s membership in the Program, in each case, with or without advance notice to the Member and without liability to the PRIME.

We make no promise that the materials on the Mobile APP are appropriate or available for use in locations outside the United Arab Emirates, and accessing the Mobile APP from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Mobile APP from elsewhere, you do so at your own initiative and risk and are responsible for compliance with local laws.

2.4 CHANGE IN USER INFORMATION

Program Members are responsible to advise the PRIME immediately of any change to their address or other contact information. The PRIME will not be responsible for any communication not received by a Program Member, if such changes are not notified by the members to the PRIME through direct profile update, mail communication or physical visit to the nearest branch.

2.5 ACCOUNT CLOSURE

To enable us to cancel Membership please visit our nearest branch and provide us with your complete name, email address and contact number clearly written out.

Upon closure of My Prime Rewards Membership account, the balance or unused points will not be refunded or transferred to any other members. The points accumulated will become Zero at the time of a Membership closure.

If Members re-initiate to enroll again into My Prime Rewards Program after account closure, the members will start the account with basic tier and zero point.

2.6 SECURITY

You expressly understand and agree that your use of the Mobile Application or site, or any material available through this source, is at your own risk. Neither PHCG nor its employees warrant that the Mobile Application or site will be uninterrupted, problem-free, free of omissions or error-free, nor do they make any warranty as to the results that may be obtained from the use of our Mobile Application or site. The content and function are provided to you "as is", without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose, use or currency.

Except as permitted from time to time by the PRIME, points cannot be assigned, exchanged, traded, bartered, purchased or given by gift or otherwise sold. Any points so acquired are void.

Points have no cash value and are not exchangeable for cash. The accumulation of points does not entitle the Program Members to any vested rights, and the PRIME does not guarantee in any way the continued availability of any reward, redemption level, rebate or any other benefit. The PRIME assumes no liability to Members as regards the addition or deletion of items from or for which points can be collected and/or redeemed.

REWARD POINTS
3.1 EARNING &REDEMPTION

Points can be earned by Program Members in connection with purchases of goods and/or services made through the PHCGfacilities (whether online and/or from physical locations). The point earned can be redeemable against any services or purchase made at PHCG facilities only.

The Members of My Prime Rewards will earn points at PHCG facilities based on the tiers and nature of services.

The points earned will expire automatically if not redeemed or used within one year from the date of earning the points. However, we may at our sole discretion impose such time limit for the validity of the redemption of My Prime Rewards Points as we deem appropriate.

For online catalogue, points can be redeemed against any items or services listed provided you have required points to purchase items or services.

At branches, if a purchase price is higher than the redemption value of the points, the remaining AED value can be paid cash or card physically on counter.

If the points are redeemed against any services availed or items purchase, then on those value will not be considered for earning the points.

3.2 UPGARED AND DOWNGRADE

We reserve the right to upgrade and downgrade the tiers automatically by the system which will be based on patient engagement with PHCG.However, we may at our sole discretion define the criteria and terms for upgrading or downgrading the Members tiers as we deem appropriate.

3.3 TRANSFERABILITY& VALUE

You understand that through your use of the Program, you consent to the collection and use of this information. As part of the Program, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Program and your Account.

Please also make sure that you have read and agree our Privacy Policy.

3.4 REFUND /CANCELLATION POLICY

Pricing errors - Although we do our best to ensure prices stated on this program are accurate, errors may occur in some cases. Where a pricing error occurs, we will not be bound by the incorrect pricing stated and reserve the right to cancel your points.

In case of invoice cancellation, the points earned will be reversed. If invoice amount changeslater onthen the Prime reserve right to reverse the earned point from Members Account.

3.5 PROMOTIONS

From time to time, the PRIME may advertise or promote exclusive offers to selected Members. The earned points will be calculated based on the discounted price and not on the gross price.

PRIVACY
4.1 CONFIDENTIAL INFORMATION

We are committed to protect your privacy. We will maintain the privacy and security of all personal information collected from Members, including, but not limited to name, address, email address, telephone numbers, date of birth, account number and purchasing information (“Personal Information”).

You understand that through your use of the Program, you consent to the collection and use of this information. As part of the Program, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Program and your Account.

Please also make sure that you have read and agree our Privacy Policy.

4.2 COMMUNICATION

By sharing your email address and as an active Member, Prime may communicate to you the special offers, services, promotions, and program information. You can unsubscribe from receiving such messages at any time by updating your online accountor by clicking unsubscribe at the bottom of any promotional email / SMS.

GENERAL
5.1 WAIVER

Every effort has been made to ensure that the information herein is correct. The PRIME is not responsible for any errors or omissions in printed copies of these Terms and Conditions nor those published from time to time on its website.

Any waiver by the PRIME of the strict observance, performance or compliance by a Member with any of the Terms and Conditions contained herein, either expressly granted or by course of conduct, shall be effective only in the specific instance and shall not be deemed to be a waiver of any rights or remedies of the PRIME as a result of any other failure to observe, perform or comply with the Terms and Conditions. No delay or omission by the PRIME in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy.

In the event that any provision in these Terms and Conditions is determined to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions of these Terms and Conditions.

5.2 DISCLAIMER

While PRIME HEALTH strives to ensure the accuracy of its product images and information, some manufacturing changes to packaging and/or ingredients may be pending updates however,no representation is made as to the completeness or accuracy of the information it contains. We will not be held accountable during a rare event of a technical glitch that may occur during maintenance or high peak hours which may cause discrepancies in your shopping bill or overall experience. This includes (but is not limited to) inconsistencies such as cached images on your device resulting in discrepancies on discounts, promotions, delivery charges etc.

5.3 COPYRIGHT & TRADEMARK

Unless otherwise noted, all the contents of the Application are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by PRIME HEALTHCARE GROUP LLC. We and our suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on this Application. Access to this Applicationdoes not confer and shall not be considered as conferring upon anyone any license under any of our or any third party's intellectual property rights. All rights, including copyright, in this Applicationare owned by or licensed to us/our affiliates. Any use of this Application or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission. You may not modify, distribute or re-post anything on this Application for any purpose.

Our names and logos and all related product and service names, design marks and slogans are the trademarks or service marks of PHCG LLC. No trademark or service mark license is granted in connection with the materials contained on this Application. Access to this Application does not authorize anyone to use any name, logo or mark in any manner whatsoever.

5.4 MODIFICATION OF PROGRAM

PHCG reserves the right to alter these terms and conditions from time to time by posting new terms and conditions. Please check our terms and conditions regularly relevant to the My Prime Rewards Program.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

5.5 JURISDICTION/GOVERNINGLAW

These terms and conditions are governed by the laws of Dubai, United Arab Emirates.
